The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 406 and 420 of the Indian Penal Code.
As per prosecution, the petitioner done fraudulently and taken huge money of informant Rabindra Singh and others in the name of sending them abroad by giving them forged visas.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He has falsely been implicated. There is no documentary proof in respect of receiving the money. Petitioner is languishing in judicial custody since 19.08.2022.
Patna High Court CR. MISC. No.61044 of 2022(2) dt.08-02-2023 2/2 Learned APP appearing for the State has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Trial No. 1661/2022, arising out of Hathua P.S. Case No. 135 of 2012, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Gopalganj.
