JUSTICE BIRENDRA KUMAR ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 366 of the Indian Penal Code. Wife of the informant had gone along with this petitioner and thereafter her dead body was recovered. Submission of the petitioner is that the petitioner along with victim lady had gone to a temple on the hill top. However, on the way itself some miscreants fired at the petitioner, causing fire-arm injury and took away the victim lady and thereafter her dead body was found. The aforesaid fact is evident from the first information lodged by the petitioner vide Rajgir P.S. Case No.99 of 2016.

Hence, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad/Successor Court, in connection with Hulasganj P.S. Case No.54 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
