====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 24-11-2022 Heard learned Senior Counsel for the petitioners. Learned Senior Counsel submits that the petitioners have filed a petition, on 04.02.2022, in Title Appeal No. 47 of 2017, under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure, for restraining the respondents not to sell the suit property. Since the filing of the injunction petition, almost ten months have passed, but the aforesaid petition is still pending.
4/4 The limited prayer of the petitioners is that learned Additional District Judge-V, Vaishali, at Hajipur, may be directed to dispose the injunction petition on its own merit within a reasonable time frame.
Taking into consideration the fact that the injunction petition is pending for the last ten months, the learned Additional District Judge-V, Vaishali, at Hajipur, is directed to dispose the injunction petition on its merit expeditiously, preferably within a period of two months from the date of receipt /production of a copy of this order.
This application is disposed of with the aforesaid observation and direction.
