2. The petitioner has preferred this application for grant of regular bail in connection with Chautham P.S. Case No. 158 of 2024 dated 31.05.2024 registered for the offence/s punishable u/ss 147, 148, 149, 341, 323, 325, 307, 379, 447, 427, 504, 506 read with section 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have come to the house of the informant's brother and started abusing. When the informant protested, all the accused persons started

It is further alleged that Mahesh Chaudhari assaulted the informant with Lathi on his head and the petitioner Dinesh Chaudhari assaulted on his chest with brick due to that four bones of the informant broke. They also looted household articles and golden chain.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case due to land dispute. There is case and counter case between the parties. The allegation against the petitioner is that the petitioner has broken four bones of the informant's chest with brick. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 31.05.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on

Patna High Court CR. MISC. No.62887 of 2024(2) dt.23-09-2024 3/3 bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Khagaria in connection with Chautham P.S. Case No. 158 of 2024.
