The petitioner seeks bail in Jalley P.S. Case No. 188/2016, registered for the offences punishable under Sections 363, 366A and 34 of the Indian Penal Code.

The father of the victim girl made allegation that petitioner Mirza Guddu Baig and Milan Ram kidnapped her minor daughter.

Learned counsel for the petitioner submits that the victim was recovered from the house of her maternal grand-father. The victim made her statement under Section 164 Cr. P.C. and she disclosed that she fell in love with the petitioner. She herself went along with the petitioner and Milan Ram to Delhi and returned from there. The petitioner and Milan Ram did not do any wrong

Patna High Court Cr.Misc. No.5590 of 2017 (3) dt.09-03-2017 acts with her. The petitioner is in jail since 26.11.2016. Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Jalley P.S.
