JUSTICE PRABHAT KUMAR JHA ORAL ORDER 07-08-2018 Heard learned counsel for the petitioner as well as learned counsel appearing on behalf of Bihar State Housing Board.

The petitioner has filed this civil miscellaneous petition for a direction to the Munsif III, Patna to dispose of the petition filed by the petitioner on 16.02.2017 under Order 39 Rule 1 and 2 read with Section 151 C.P.C..

The learned counsel for the petitioner submits that the Court heard the petition and finally fixed the case on 28.11.2017

Patna High Court C.Misc. No.1062 of 2018 (2) dt.07-08-2018 for orders on the petition filed by the petitioner under Order 39 Rule 1 and 2 read with Section 151 C.P.C. but till date no order has been passed.

Having considered the submission of the learned counsel for the petitioner, I find it appropriate that the Court of Munsif III, Patna is directed to dispose of the petition of the petitioner filed on 16.02.2017 within two months from the date of receipt of this order.

Accordingly, this civil miscellaneous petition is disposed of with the direction aforesaid.
