JUSTICE ARUN KUMAR ORAL ORDER 09-03-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.

Petitioner already in custody in connection with Sessions Trial No.77 of 2016, arising out of Ander P.S. Case No.156 of 2015 is an accused in a case registered under Sections 302/34 of the Indian Penal Code.

Allegation in brief is that due to land dispute, all the accused persons assaulted the deceased indiscriminately by lathi, danda and axe.

It is submitted that due to partition dispute, all family members have been falsely implicated. There is no injury of hard and blunt substance on the person of the deceased, all are incised wound and it is not stated that petitioner was armed with any sharp cut weapon and another co-accused, namely, Kamlawati

Patna High Court Cr.Misc. No.5605 of 2017 (3) dt.09-03-2017 2 / 2 Devi has been granted bail by a coordinate Bench of this Court by order dated 15.07.2016, passed in Cr. Misc. No.19952 of 2016 and this petitioner has been in custody since 27.01.2016. It is also submitted that the petitioner has got no criminal antecedent. Having considered the said facts and circumstances, let the petitioner, namely, Chandrika Sah be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge, Siwan in connection with Sessions Trial No.77 of 2016, arising out of Ander P.S. Case No.156 of 2015.
