JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case registered for an offence punishable under Sections 353, 506, 341 of Indian Penal Code and 3 (i) (x) of S.C./S.T. Act. As per the prosecution case, the informant, the informant, a police officer along with others had gone to the petitioner's house for the purpose of pasting the notice under section 80 of the Cr. P.C. to apprehend the petitioner's son. The petitioner is said to have caused obstructions and abused them and did not allow to paste the notice.

Learned counsel for the petitioner has submitted that 353, 506 and 341 of the I.P.C. is bailable and no offence under Section

Patna High Court Cr.Misc. No.41952 of 2014 (2) dt.04-03-2015 2/2 3(i) (x) of SC/ST is made out on the basis of allegation as contained in F. I. R.

From the F.I.R., I found that submission made on behalf of the petitioner that no offence under the provisions of SC/ST ACT is made out on the basis of allegation as mentioned in the F.I.R., is acceptable and this application is accordingly, allowed. Considering the facts and circumstances, in case of arrest or surrender within a period of four weeks, the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Muffasil P.S.Case No. 179/2014, subject to condition as laid down under Section 438( 2) of Cr.
