The petitioner, who is in custody, seeks bail in connection with Hussainganj P.S.Case No.105 of 2002 registered under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner is that he is the order giver and his son shot at the deceased.

It is submitted by learned counsel for the petitioner that there is some partition dispute between the petitioner and the cousin of the deceased and the allegation of firing on the deceased is against Danish Siddiki, who is the son of this petitioner and the petitioner has no criminal antecedent.

Having considered aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.6167 of 2017 (2) dt.08-02-2017 2/2 the petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Siwan in connection with Hussainganj P.S. Case No. 105 of 2002.
