The petitioner seeks regular bail in connection with Pouthu P.S. Case No. 20 of 2013 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 379, 435 of the Indian Penal Code, Section 27 of the Arms Act, Section 17 C.L.A. Act and Section 10 Unlawful Activities (Prevention) Act.
The only material against the petitioner is the confessional statement of co-accused Yogendra Bhuiyan. Learned counsel for the petitioner submits that the petitioner has been made accused on the basis of confessional statement of co-accused Yogendra Bhuiyan before the police. Patna High Court Cr.Misc. No.5570 of 2017 (2) dt.07-02-2017 2/2 situated co-accused Yogendra Bhuiyan has already been allowed regular bail vide order dated 14.05.2014 in Criminal Miscellaneous No. 11733 of 2014 passed by another coordinate Bench of this Court and the petitioner is in custody since 24.12.2016.
Considering the nature of allegation against the petitioner and similarly situated co-accused has already been granted the privilege of bail, let the petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Pouthu P.S. Case No. 20 of 2013.
