JUSTICE SANJAY PRIYA ORAL ORDER 04-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sitamarhi (Punaura O.P.) P.S. Case No. 375 of 2016 instituted for the offence under Sections-392/34/ 395, 412 of the Indian Penal Code. It is alleged in the fardbyan of the informant Munna Singh that on 13-06-2016 at about 2.30 p.m. three miscreants came inside the office of Chandra Indane Agency and looted away a bag containing cash Rs. 2,32,006/- which was the sale proceed of the gas.

Case diary has been called for.

The learned APP refers paragraphs-29, 39 & 40 of the case diary and submits that mere suspicion has been raised against the petitioner. It has further been submitted that co-accused Vishal

Patna High Court Cr.Misc. No.7246 of 2017 (3) dt.04-04-2017 2/2 Anand, whose confessional statement was recorded at para-58 of the case diary, named the petitioner. Witnesses in paragraphs-68, 69 & 70 have also raised their suspicion against this petitioner. From the order of learned Sessions Judge also, it appears that besides criminal antecedent against this petitioner, there is no substantive material against this petitioner to show the involvement of the petitioner in the aforesaid occurrence. The petitioner is said to be in custody since 27-09-2016. In the aforesaid circumstances, prayer for bail is allowed. The petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sitamarhi (Punaura O.P.) P.S. Case No. 375 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi subject to condition that both the bailors will be the close relatives of the petitioner.
