Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Accusation in the FIR is that the petitioner and others indiscriminately fired at Wasi Ahmad as a result whereof Wasi Ahmad died.
Witness Manjer Imam stated before the police vide paragraph 28 of the case diary that this petitioner had caused firearm injury at Wasi Ahmad. This fact has already been noticed by a coordinate Bench of this Court in Cr. Misc. No. 31578 of 2016.
The petitioner is in custody since 02.05.2016.
Patna High Court Cr.Misc. No.8629 of 2017 (3) dt.10-04-2017 2/2 Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail for the present in connection with Hussainganj Police Station Case No. 14 of 2016 pending in the Court of learned Chief Judicial Magistrate, Siwan.
Hence, prayer for bail is refused.
The learned trial Court is directed to expedite the trial. If the same is not concluded within six months, the petitioner may renew his prayer for bail before the learned trial Court itself who shall pass a reasoned order.
