JUSTICE BIRENDRA KUMAR ORAL ORDER 01-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 30(a) of the Bihar Excise (Amendment) Act, 2016.
About twenty-two bottles of foreign liquor each containing 180 ml and three bottles each containing 750 ml were recovered from the backside of the hut of the petitioner. Submission is that petitioner has stated on oath that he has got no criminal antecedent and is in custody since 22.12.2016.
Considering the entire facts and circumstances,
Patna High Court Cr.Misc. No.8595 of 2017 (2) dt.01-03-2017 2/2 let petitioner, above named, be enlarged on bail after completion of four months of custody on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran/Successor Court, in connection with Excise P.S. Case No. 411 of 2016.
