In this case, the petitioner is facing a criminal case for offence under Sections 3(2) read with section 13(1)(e) of the Prevention of Corruption Act. At the same time, he is also facing a departmental proceeding. The petitioner has been put under suspension on 25.04.2016 and memo of charge has been served on 28.09.2016, but still the department has not concluded the inquiry.

Patna High Court CWJC No.14690 of 2018(2) dt.07-09-2018 2/2 Let the respondents conclude the inquiry proceeding within six months from the date of receipt/production of a copy of this order. It is expected that the petitioner would co-operate in early conclusion of the Inquiry proceeding and if he fails to extend co-operation, the Inquiry Officer will be at liberty to complete the inquiry ex parte. With the aforesaid observations and directions, this writ petition is disposed of.
