JUSTICE BIRENDRA KUMAR ORAL ORDER 21-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 302/201/34 of the Indian Penal Code.
The F.I.R. is against unknown. The offence alleged is murder. Name of the petitioner transpired in the confessional statement of co-accused, who was arrested on suspicion.
It appears that co-accused Sanjay Singh @ Sanjay Kumar Singh, who had confessed before police, has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No. 19242 of 2015 on 23.06.2015.
Considering the aforesaid facts, let petitioner,
Patna High Court Cr.Misc. No.7723 of 2017 (2) dt.21-02-2017 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Bhagalpur/Successor Court, in connection with Bhagalpur (Rail) P.S. Case No.40 of 2014.
