====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 12-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Sitamarhi P.S. Case No. 103 of 2021 registered under Sections 147, 148, 149, 302 and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 23.09.2021, is a person with clean antecedent, charge-sheet has been submitted in the case and the informant alleges that Chhotu Kumar gave knife blow to Vikki Kumar on account of dispute relating to rupees two and further five named accused persons also assaulted him, further when people gathered it is alleged that the petitioner helped the accused person in fleeing. Learned counsel submits that the petitioner is not alleged to have assaulted, the only allegation against him that he helped the accused persons in fleeing and

Patna High Court CR. MISC. No.72011 of 2021(2) dt.12-05-2022 2/2 the allegation appears to be general and omnibus in nature. The learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 23.09.2021, is a person with clean antecedent and chargesheet has been submitted in the case in the nature of allegation as alleged; the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sitamarhi P.S. Case No. 103 of 2021.
