JUSTICE AMARESH KUMAR LAL ORAL ORDER 22-01-2015 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The accused-petitioners seek bail in a case registered for the offence punishable under Sections 304(B), 201, 120(B) of the Indian Penal Code.

Allegation against the petitioner and other co-accused is that they were demanding motorcycle and Rs.50,000/- in cash and due to non-fulfilment of demand of dowry the deceased has been tortured and it has been suspected that she has been killed and her dead body has been disposed of.

It is submitted that petitioner no. 1 is the father-in-law

Patna High Court Cr.Misc. No.42949 of 2014 (3) dt.22-01-2015 2/3 of the deceased aged about 70 years and petitioner no. 2 is Debar of the deceased and both of them were living separately with the deceased and her husband.

It is further submitted that the deceased was married with Dilip Singh 17 years ago and out of their wedlock two children were born aged about 11 years and 8 years. The date of birth of Neha Kumari, the daughter of the victim is 21.12.2003 and up till now the dead body has not been recovered. The petitioners have no criminal antecedent.

Considering the facts and circumstances, the above named petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka /court concerned in Shambhuganj P. S. Case No. 62 of 2014 with following conditions:-

1. The petitioners will not indulge themselves in similar or any other offence.

2. One of the bailors must be the close relative of the petitioners.

3.

The petitioners will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail,

Patna High Court Cr.Misc. No.42949 of 2014 (3) dt.22-01-2015 3/3 their bail bonds would be liable to be cancelled by the learned Court concerned.
