JUSTICE SANJAY PRIYA ORAL ORDER 2/ 22-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Mirganj P.S. Case No.374 of 2016 instituted for the offence under Section(s) 272, 273 Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act.

It is alleged that 160 bottles of illicit country made liquor each of 200 ML were recovered from the possession of this petitioner.

Seizure list is enclosed with the First Information Report, which does not bear the signature of the petitioner, which is in clear violation of Section 100(6) of the Code of Criminal Procedure. Petitioner is in custody since 04.012.2016 having clean antecedents.

Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, XVI, Gopalganj, in connection with Mirganj P.S.
