JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-10-2015 Heard learned counsel for the petitioners, the learned A.P.P. for the State and learned counsel for the Informant. The petitioners apprehend their arrest in connection with Ekangarsarai P.S. Case No. 93 of 2015 registered under Sections 302 and 494/34 of the I.P.C.
The prosecution case is that marriage of sister of the informant, Kiran Devi was performed with Bhushan Prasad before 20 years and from their wedlock, there is one son, Dharambir Kumar. After few years of the marriage, Bhushan Prasad performed re-marriage with Sobha Devi, petitioner no.1 then the petitioners and Bhushan Prasad used to assault his sister, due to which she became ill, while she was being accompanied by
Patna High Court Cr.Misc. No.42750 of 2015 (2) dt.14-10-2015 2/2 informant for better treatment and died in the way. Learned counsel appearing on behalf of the petitioners submits that petitionerno.1 is second wife of Bhushan Prasad and petitioner no.2 is mother-in-law of the deceased. They have falsely been implicated in this case. It is also submitted that there is no any external injuries found over the whole body, except swelling over left parietal region.
Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by him within six weeks, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Hilsa, Nalanda in connection with Ekangarsarai P.S. Case No. 93 of 2015, subject to the conditions laid down under Section 438(2) Cr. P.C.
