JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Although petitioner is named in the first information report but no specific overt act has been attributed against him. It would appear that the alleged occurrence took place in the year 2004 and petitioner could be remanded in this case on 22.07.2015. The stand of the petitioner is that some co-accused having similar allegation were granted privilege of anticipatory bail and petitioner was under impression that he was, too, granted bail by the Court and being an illiterate person he went outside the State in connection with his livelihood and when he returned to his home, he came to know that his case is still pending and,

Patna High Court Cr.Misc. No.43921 of 2015 (2) dt.22-09-2015 2/2 thereafter, he approached the court and was taken into custody. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari in connection with Turkauliya P.S.Case No. 101 of 2004.
