The petitioners have filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 504 and 506 of the Indian Penal Code.

The allegation against the petitioners along with other accused persons is that they have assaulted to the informant and his family members by means of kudal, farsa, iron rod and lathi due to which father of the informant namely, Dhruv Yadav, grandfather of the informant namely, Chhotan Yadav and other family members of the informant have sustained injury.

Patna High Court CR. MISC. No.62766 of 2023(2) dt.05-10-2023 2/2 It is submitted by learned counsel for the petitioners that the petitioners are innocent and have committed no offence. They have falsely been implicated in the present case. There is case and counter case between both the parties. General and omnibus allegation has been levelled against the petitioners. The injuries sustained by both the parties are all simple except one injury sustained by Chhotan Yadav causing fracture in his right leg and except that there is no serious injury. It is also submitted that petitioners are languishing in judicial custody since 10.07.2023. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Lauria P.S. Case No.194 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah.
