The petitioners seek regular bail in connection with Bibiganj PS case No.5 of 2019 registered for offences punishable under Sections 363, 366(A) of the Indian Penal Code.

Petitioner happens to be father and uncle of one Niraj Kumar Nishad and there is allegation that they kidnapped the minor daughter of the informant.

Submission of the learned counsel for the petitioners is that except that there is no specific allegation against the petitioner and he is in custody since 1.6.2019.. The girl has been recovered and she has stated in her statement under

Patna High Court CR. MISC. No.59105 of 2019(3) dt.16-11-2019 2/2 Section 164 Cr.P.C. that she has gone on her own sweet will and married with the son of the petitioner no.1.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM III, Kishanganj in connection with Bibiganj PS Case No.5 of 2019. With the above direction, this application is allowed.
