JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 18-09-2015 Heard learned counsel for the petitioner and the State. It appears that the appeal filed by the petitioner was dismissed for non-prosecution on 28.06.2013.

In view of the submissions made and in the in the ends of justice, I am inclined to grant one more opportunity to the petitioner to represent his case before the appellate authority, as such the impugned order dated 28.06.2012 is set aside and the appeal no. 88 of 2010-11 is revived.

It is expected that the appeal would be disposed of within a period of three months from the date of receipt of a copy of this order.

This application stands allowed.
