Learned counsel appearing on behalf of the respondents submits that the valuation of the present appeal is Rs. 3,00,000/-, while the pecuniary jurisdiction of the District Judge to hear the Title Appeal is up to valuation of Rs. 10,00,000/-. As such, the present Memo of Appeal may be returned for presenting the same before the learned District Judge, Jehanabad. Learned counsel for the appellants does not dispute the submission of learned counsel for the respondents but submits that delay in filing the appeal in this Court has already been condoned vide order dated 07.12.2015.
