JUSTICE PRABHAT KUMAR JHA ORAL ORDER 12-09-2018 Heard Mr. Jagannath Singh, learned counsel appearing on behalf of the petitioner and Mr. Sanjay Kumar Ghosarvey, learned counsel appearing on behalf of the State. The petitioner has filed this M.J.C. for initiation of a contempt proceeding against the respondents who have violated the order dated 16.02.2017 passed in CWJC No.13981 of 2008. Mr. Jagannath Singh, learned counsel for the petitioner submits that the petitioner filed CWJC No.13981 of 2008 against the order of his dismissal and by the order dated 16.02.2017,

Patna High Court MJC No.2507 of 2018 (2) dt.12-09-2018 passed in CWJC No.13981 of 2008, the order of dismissal of the petitioner has been set aside and the writ was allowed with a direction to the disciplinary authority to hold enquiry afresh after appointing presenting officer and proceed in accordance with law. The authority has already appointed presenting officer and initiated departmental proceeding against the petitioner. It is submitted that no subsistence allowance is paid to the petitioner, for that, the petitioner may file petition before the concerned authority for payment of subsistence allowance but I find that no order of this Court has been violated by the respondents.

Accordingly, this contempt petition is dismissed. (Prabhat Kumar Jha, J) Saurabh/- U
