JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 This is an application for grant of anticipatory bail in connection with Ramgarhwa P. S. Case No. 239 of 2018, disclosing offences under Sections 447, 341, 323, 354, 380, 504, 34 of IPC and Section 27 of the Arms Act.

Petitioner along with several other accused persons are named in the F.I.R. There is allegation that petitioner and other accused persons assaulted the informant taking him to his door and thereafter, assaulted him. Specific allegation is against Sanjeev Kumar Singh, Manjeet Kumar Singh, Shyam Kishore Singh and allegation against this petitioner is of taking away golden ring.

Submission of the learned counsel for the petitioner is that there is case and counter case between the parties. There is no allegation of assault against this petitioner.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M., Raxaul at Motihari, East Champaran, in connection with Ramgarhwa P. S. Case No. 239 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
