In the present case, petitioner has raised a grievance that order with respect to completion of departmental proceeding has not been done expeditiously in terms of the order dated 6.1.2014 passed in C.W.J.C. No. 39 of 2014. It will be relevant to quote the aforesaid order: "After full argument and when the Court was not convinced, learned counsel for the petitioner seeks
Patna High Court MJC No.3962 of 2014 (2) dt.23-05-2017 permission to withdraw this application.
Permission is granted. This application is dismissed as withdrawn.
However, petitioner shall participate and cooperate in the departmental proceeding in all manner and the respondents shall dispose of the proceeding as expeditiously as possible and in any case within the time frame fixed by the Government circular contained in Letter No.2178 dated 28.02.2007 of the Personnel & Administrative Reforms Department".
From the show cause filed on behalf of the Principal Secretary, Rural Works Department, Bihar, Patna it appears that proceeding has been concluded and punishment has been awarded. In such view of the matter, this application has been rendered infructuous.
Accordingly this application is dismissed as having become infructuous.
