ANJANA MISHRA ORAL ORDER 09-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is renewing his prayer for regular bail on the premise that the court below has entertained the dilatory tactics adopted by the prosecution and entertained the application of the prosecution for summoning witnesses all over again, specially at stage where the trial was posted for judgment. This court does not appreciate as to under what circumstances such an order has been passed and such alleged at the stage of trial. However taking into consideration the fact that the petitioner has already been in custody since 10.01.2014 and the case is at final stage, the trial court is directed to conclude the trial of the present case within a period of three months from the

Patna High Court Cr.Misc. No.45451 of 2016 (2) dt.09-11-2016 2/2 date of production of the copy of this order. It is made clear that under no circumstances the prosecution as also the defence shall be granted any adjournment and the trial shall proceed on day to day basis so that it is completed within the aforementioned time. In view of the aforementioned observation, the present application stands disposed of.
