JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-04-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in connection with Kurhani P.S. Case No. 353 of 2016, registered under Section 395 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioners are not named in the F.I.R. but in course of investigation, both petitioners were apprehended on suspicion by the police, who got recorded the confessional statement of the petitioners, showing the involvement in the present case and also involvement of the petitioners in Kudhni (Turki O.P.) P.S. Case No. 291 of 2016. Further submission is that petitioners are in

Patna High Court Cr.Misc. No.6761 of 2017 (4) dt.19-04-2017 custody since 21.12.2016.

Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Muzaffarpur (West) in connection with Kurhani P.S. Case No. 353 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
