JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-01-2022 The present petition is by way of second attempt at the behest of the petitioner for grant of regular bail in connection with Yadopur P.S. Case No. 101 of 2019 for the offence punishable under Sections 302/34 of the Indian Penal Code, Section 27 of the Arms Act in as much as his prayer for grant of bail was rejected by this Court earlier vide order dated 21.9.2020 passed in Cr. Misc. No. 17442 of 2020. The case of the prosecution in brief is that the informant along with her husband and sister-in-law had gone to their field for looking at the water tank on 10.03.2019 at about 10:30 A.M. when the petitioner and seven other accused persons had arrived there, surrounded the husband of the informant and had started assaulting him. The learned counsel for the petitioner has submitted that the petitioner is languishing in custody since 16.12.2019 and there is no progress in the trial. Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner, this Court finds that there is a direct allegation qua the petitioner herein of having fired gun shots on the deceased, resulting in his death and moreover, there is no change in circumstance so as to warrant reconsideration of the prayer for bail of the petitioner, thus I do not find any merit in the present petition. Accordingly, the present petition stands dismissed.
