JUSTICE BIRENDRA KUMAR ORAL ORDER 04-04-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offence punishable under Section 273 of the Indian Penal Code. Foreign liquor was recovered from a motorcycle on which the petitioner was a pillion rider.

Co-accused Naimul Haque, was also on the same motorcycle, has been granted bail by a coordinate Bench of this Court vide order dated 06.03.2017 passed in Cr. Misc. No. 7912 of 2017.

Considering the aforesaid facts, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate,

Patna High Court Cr.Misc. No.8248 of 2017 (3) dt.04-04-2017 2/2 Purnea/successor Court in connection with Baisi Police Station Case No. 230 of 2016, subject to the condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
