The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on receiving information about the accused persons being involved in manufacture of liquor, it is stated that a raid was conducted. Seeing the police personnel, 6-7 accused persons managed to escape. 10 litres of country liquor and 2500 litres of jawa mahua liquor was recovered from the place where liquor was being manufactured. As per information provided by the spy, the petitioner was also involved in the business of liquor.

It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any

Patna High Court CR. MISC. No.71381 of 2021(2) dt.07-06-2022 2/2 incriminating article recovered from his possession. The cause of his false implication is his antecedent. He is in custody since 27.10.2021 and investigation in the case has concluded. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the petitioner not having been arrested at the spot nor having any concern with the place from which the alleged liquor etc. was recovered, the Court directs the petitioner to be enlarged on bail in connection with Gogari P.S. Case no.410 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Khagaria.
