Petitioner, a stranger to the suit had field at an earlier occasion for his impleadment as one of defendant during midst thereof, Jaggi Singh the plaintiff died and on account thereof, a dispute has arisen relating to succession. At an earlier occasion petitioner was identified as his successor which, subsequently in light of order dated 10.05.2011 passed in CWJC No.838 of 2011 (Annexure-5) has gone against the petitioner identifying Birendra Singh, respondent no.5 to be his successor of Jaggi Singh on account of which, petitioner has filed instant petition.
After hearing the rival parties it looks a clumsy
Patna High Court CWJC No.11036 of 2012 (6) dt.27-11-2015 affair to notify over manner of adoption as well as status of either of the parties to be the legal heir of deceased Jaggi Singh. That being so, giving a liberty to the petitioner to have his plea duly adjudicated upon by a legally constituted suit, instant petition is disposed of.
