2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 341, 324, 323, 326, 307, 353, 333, 504/34 of the Indian Penal Code, registered in connection with Kochadhaman P.S. Case No. 149 of 2003.

3. As per prosecution case, the petitioner is said to have stabbed the informant with an intention to kill.

4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and has committed no offence. He submitted that the informant has been examined as P.W. 1 and during his deposition he stated that he

Patna High Court CR. MISC. No.63740 of 2024(2) dt.12-09-2024 2/2 could not identify any of the miscreants whereas in the FIR he has named the accused persons including the petitioner, so as such the statement is contrary to the fardebayan. Petitioner is in custody since 28.09.2023.

5. Learned APP for the State has opposed the prayer of bail.

6. Considering the above facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Kishanganj in connection with Kochadhaman P.S. Case No. 149 of 2003, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
