Petitioner is named in the first information report with allegation that he opened fire which hit injured Nikhil Singh @ Nikki Singh. The statement of injured Nikhil Singh @ Nikki Singh has been recorded in course of investigation at para 22 of the case diary and in the said statement the aforesaid injured admitted that firing was made from outside the shop when shutter of shop was closed and he could not see the person who fired at him, though he claimed to have seen the petitioner having pistol in his hand prior to opening fire. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate,
