====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 10-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Salaiya P.S. Case No. 50 of 2021 registered under Sections 379, 413, 414 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since 23.09.2021, charge-sheet has been submitted in the case and has antecedent of three cases in which he has been acquitted in Madanpur P.S. Case No. 230 of 2012, though at Para 3 it has been inadvertently typed that he has been acquitted in Aurangabad Session Case No. 918 of 2017. It is further submitted that informant alleges that one stolen motorcycle was recovered from the possession of the petitioner who disclosed that he had purchased the motorcycle from

Patna High Court CR. MISC. No.71342 of 2021(2) dt.10-05-2022 2/2 Rajesh and Sushil. Further, from Rajesh and Sushil also motorcycles were recovered.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, he was completely unaware the purchased motorcycle is stolen one. The learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 23.09.2021, charge-sheet has been submitted in the case and taking into consideration the submissions made by learned counsel for the petitioner, let the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Salaiya P.S. Case No. 50 of 2021, with a condition that one of the bailors shall be the father of the petitioner namely, Jagannath Singh.
