Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 365, 366/34 of the Indian Penal Code.

Prosecution's case in short is that informant has suspected that these petitioners got her dughter enticed away with someone.

Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case on the basis of suspicion. Petitioner no.1 is daughter of petitioner no.2. It is further submitted that there

Patna High Court CR. MISC. No.71152 of 2021(3) dt.31-08-2022 2/2 is delay of 13 days in lodging of the FIR and there is no plausible explanation of delay. No tangible evidence has been collected during course of investigation to suggest the implication of this petitioner in the present case. Even in the supervision note contained in para 15 of the case diary it has come that the informant resides in Delhi with his family where he drives vehicles from where his daughter has gone with a boy of her own choice due to love affairs and these two petitioners have been implicated in this case on on the basis of suspicion. Petitioners have got no criminal antecedent.

Considering the nature of allegation against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate V, West Muzaffarpur in Karja Police Station Case No. 94 of 2021, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
