Heard learned counsel for the petitioners and learned counsel for the State.
In this case, the petitioners are seeking anticipatory bail in connection with Sigori P.S. Case No.41 of 2014, registered for the offence punishable under Sections 341, 342, 323, 448, 379, 504 and 506 of the Indian Penal Code. Allegation has been made that on 26.05.2014 the informant was coming from Raipur by a vehicle and unloaded the goods at Fatuhan. After conciliating the account, he obtained Rs.38,700/- along with his Rs.10,000/-. When he reached near

No.19837 of 2017 (4) dt.19-08-2017 2/2 his village, he parked his vehicle at the door of his uncle and as soon as he get off from the vehicle, the accused persons caught hold of the informant and started assaulting him, from there he managed to escape, but thereafter he was again intercepted and caught hold him by the petitioners and assaulted him mercilessly. Learned counsel for the petitioners submits that petitioner no.1 has earlier lodged case against the informant with respect to taking the loan of Rs.25,000/- and to evade payment, the present case has been lodged.
Looking to the facts and circumstance of the case, let the above-named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Sigori P.S. Case No.41 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Shivaji Pandey, J) pawan/- U T
