JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19.07.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.
Earlier prayer for bail of the petitioner was rejected by this court taking note of the statement of the victim and trial court has reported that up till now, four prosecution witnesses have already been examined.
Therefore, taking into consideration that trial of the petitioner has already commenced, I do not think it proper to release the petitioner on bail and accordingly, his prayer for bail in connection with Session trial no. 338 of 2016 arising out of Amour P.S. Case no. 87/2015 pending in the court of Addl. Sessions Judge V, Purnea stands rejected.
However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible. shahid (Hemant Kumar Srivastava,J) U T
