Petitioner seeks bail in a case registered for the offences punishable under Sections 489(B), 489(C), 489(E) and 420 of the Indian Penal Code.
Petitioner is in custody since 05.06.2017. Earlier prayer for bail was refused on 03.04.2018 in Criminal Miscellaneous No.55440 of 2017.
Allegation is that huge quantity of fake currency note was recovered from the house of the petitioner. Submission of learned counsel for the petitioner is that recovery was not from the conscious possession of the petitioner and petitioner is ready to co-operate with the trial. The
Patna High Court CR. MISC. No.63174 of 2019(2) dt.16-10-2019 2/2 trial is at the stage of prosecution evidence. Considering the period already undergone and undertaking of the petitioner to co-operate with the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Sessions Trial No.89 of 2018, arising out of Kursela Police Station Case No.40 of 2017, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
