2. The petitioner has prayed for regular bail in a case instituted for the offence under Sections 323, 307 and 498(A) of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.

3. As per prosecution case, the complainant was married with the petitioner 26.06.2014 after marriage the complainant went to sasural and lived happily. Thereafter, it is

No.62891 of 2023(2) dt.22-09-2023 2/3 alleged that she was given physically and mentally tortured and the petitioner and his family members demanded Rs. 3 lacs from her otherwise, she will be killed. It is further alleged that the accused persons tried to kill her by sprinkling kerosene oil on her body but anyhow complainant saved her life and the accused persons ousted the complainant from their house.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. Petitioner is the husband of the complainant and he neither tortured the complainant, nor demanded dowry from her. Petitioner is ready to keep his wife (complainant) with full dignity and honour. Petitioner has got no criminal antecedent as stated in para-3 of the bail petition. He is languishing in judicial custody since 21.02.2023.

5. The application for bail is opposed by learned APP for the State and learned counsel for the informant.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the
