====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-10-2024 Heard learned counsel for the petitioner and the State.
2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.
3. As per the prosecution case, petitioner handed over pistol to her son Rahul who gave it to co-accused Kaushal who fired on husband of the informant causing his death.
4. Learned counsel appearing for the petitioner submits that the petitioner is not the assailant of the deceased. Petitioner is a lady and as a matter of fact she was not present on the spot at the time of alleged offence and has been named because she happens to be mother of aforesaid co-accused. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the prayer for bail.
6. Considering the aforesaid facts of the case, prayer
Patna High Court CR. MISC. No.67994 of 2024(2) dt.23-10-2024 2/2 for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I Hilsa Nalanda in Chandi/Wena Police Station Case No. 333 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
