====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE and HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 21-11-2019 Heard learned counsel for the petitioners and learned counsel for the respondent.
This application has been filed with a prayer to quash the interim order dated 3.1.2019 passed in O.A. No.60/23/2019 (Priya Kumari Vs. The Union of India & Ors.) passed by the Central Administrative Tribunal, Patna Bench whereby and whereunder the learned Tribunal has granted ad-interim relief to the respondent by directing the respondents to restrain from
Patna High Court CWJC No.22906 of 2019(2) dt.21-11-2019 2/3 implementing the impugned order dated 20.12.2018 till the next date of hearing.
Learned counsel points out that while passing the impugned order, perhaps, it escaped the attention of the Hon'ble Members of the Bench that in a case of another similar applicant a different order came to be passed.
We notice that the impugned order was passed way back on 3rd of January, 2019.
As such, we see no reason to interfere at this point of time save and except that the order being interim in nature, it is open for the petitioner to invite the attention of such of the Hon'ble Bench. Only if the Bench refrains from vacating the order, it would be appropriate for the petitioner to approach this Court.
With the aforesaid observation, this application is disposed of.
In any event, we request the Hon'ble Bench to hear the matter on merits and decide the same expeditiously and preferably within a period of three months from the date of presentation of a copy of this order.
Learned counsel points out that proceedings of contempt have been issued. We are sure that with the passing of
Patna High Court CWJC No.22906 of 2019(2) dt.21-11-2019 3/3 the instant order, the Tribunal shall refrain from passing any order thereupon.
