Petitioner seeks bail in connection with Banka P.S. Case No. 94 of 2017 registered under Sections- 272, 273 of the Indian Penal Code and section 30(a), 35(c) of the Bihar Excise Prohibition Amendment Act, 2016.

Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. During investigation witnesses have not supported the prosecution case. Petitioner is a student and apart from that he is engaged in laundry work. Petitioner has no criminal antecedent and is in custody since 13.02.2017. Considering the facts and circumstances of the
