JUSTICE BIRENDRA KUMAR ORAL ORDER 02-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Section 376/34 of the Indian Penal Code. The petitioner was allegedly involved in gang rape against the informant.

Submission of the petitioner is that the victim has not supported the allegation against her in her statement under Section 164 Cr.P.C.

The aforesaid might be resulted tampering with the evidence.

Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer

Patna High Court Cr.Misc. No.20594 of 2017 (2) dt.02-05-2017 for bail in connection with Mahila P.S. Case No.141 of 2015 pending in the court of learned Chief Judicial Magistrate, Nalanda is refused.
