2. The petitioner is in judicial custody in connection with Lakhisarai P.S. Case No. 464 of 2024 for the offences punishable under Sections 309(4) of the Bharatiya Nyaya Sanhita, lodged on 22.07.2024 by the informant, Babita Singh.
3. As per the prosecution story, the informant alleged that while the lady was visiting Durga Mandir, her golden chain was snatched. It was captured in the CCTV footage and that led to arrest of Ankush Kumar.
4. The case of the petitioner as narrated by Mrs. Vaishnavi Singh is that Ankush Kumar is the person who snatched the chain, the petitioner runs Raushan Jewellers being
Patna High Court CR. MISC. No.64539 of 2024(4) dt.11-12-2024 2/3 its proprietor, had no knowledge that it is a stolen chain. Ankush Kumar came and disclosed that there is illness in family and urgent need of money. Full amount was gave to him after weighing the chain but ultimately became an accused in this case. The petitioner do not have criminal antecedent. The last submission is that Ankush Kumar has been granted bail in Cr. Misc. No. 77168 of 2024 by a coordinate Bench on 26.10.2024.
5. Learned APP for the State opposes the prayer submitting that he is alleged to have bought the chain which was snatched by Ankush Kumar.

Considering the submissions put forward by the parties as also the fact that the petitioner is the owner of a Jewellery Shop, he has no criminal antecedent, is in custody since 24.07.2024, the main accused Ankush Kumar has been extended relief, as stated above, this Court is inclined to extend him the privilege of bail.
7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 464 of 2024, subject to the following conditions: (i) one of the bailor should be the family

(ii) the petitioner shall appear on each and every date before the Trial Court failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall appear before the concerned police station every fortnight for next six months to mark his attendance;
(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of bail bonds. (Rajiv Roy, J) vinayak/- U T
