2. The petitioner has preferred this application for grant of regular bail in connection with Magadh University P.S. Case No. 147 of 2022 dated 16.06.2022 registered for the offences punishable u/ss 147, 148, 149, 341, 323, 324, 307 and 506 of the Indian Penal Code.
3. As per the prosecution case, when the informant's uncle, Birju Yadav and his grand-father Dhani Yadav were sitting near the house of Birju Yadav then the petitioner and the co-accused persons armed with lathi-danda, khanti and iron rod came there and told to kill them. The petitioner assaulted the informant's uncle with khanti with the intention to kill him due
Patna High Court CR. MISC. No.60256 of 2025(2) dt.10-09-2025 2/3 to which he sustained head injury. The accused persons also assaulted the informant and his family members causing injuries to them and when they raised alarm, the accused persons fled away from the spot.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is case and counter case between the parties. It is further submitted that there is an admitted land dispute between the parties. Nothing has been recovered from the conscious possession of the petitioner. The co-accused persons has already been granted bail by a Coordinate Bench of this court vide order dated 12.05.2023 passed in Cr. Misc. No. 18471/2023. As per the injury report of the informant, the injury is simple in nature. The petitioner has four criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 03.06.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of
Patna High Court CR. MISC. No.60256 of 2025(2) dt.10-09-2025 3/3 the like amount each to the satisfaction of learned Court concerned, Gaya in connection with Magadh University P.S. Case No. 147 of 2022 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
