JUSTICE BIRENDRA KUMAR ORAL ORDER 03-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 302/120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

The occurrence of murder was not seen by anyone. However, some persons are named in the F.I.R. The petitioner is not named in the F.I.R. Name of the petitioner has transpired in the confessional statement of co-accused Rahul Kumar Yadav, who is also not named in the F.I.R. Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.20640 of 2017 (2) dt.03-05-2017 2/2 each to the satisfaction of learned Chief Judicial Magistrate, Araria/Successor Court, in connection with Narpatganj P.S. Case No.23 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
