JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-08-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 420, 467, 468, 470, 471/34 of the Indian Penal Code and u/s 3 of Damage of Public Property Act.

As per the prosecution case, this petitioner, on the basis of forged and fabricated document, was constructing house on the land of Bihar State Housing Board.

Learned counsel appearing for the petitioner submits that entire prosecution case is false and fabricated. Petitioner has nothing to do with the land in question. He is not the owner of the land and he is resident of Adarsh Colony, Patel Nagar, Patna.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Patna in connection with Rajeev Nagar PS case No. 338/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
