The petitioners apprehend their arrest in Bahera P.S. Case No. 370/2015, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. The informant alleged that both the petitioners and others were trying to take possession of their land and when the informant protested the petitioners assaulted him and his son and other family member. There is counter version bearing Bahera P.S. Case No. 375/2015.

It is submitted that there is admitted land dispute between the parties. Domi Sah the informant and his son got simple injury.

No.46455 of 2016 (2) dt.30-11-2016 2/2 Considering the facts aforesaid and the fact that there is land dispute between the parties and on account of assault by the petitioners the informant and his son got simple injury and no other person got any visible injury, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate Benipur, Darbhanga in connection with Bahera P.S. Case No. 370/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
